These Terms apply to your use of thermosnug.com and any purchase from ThermoSnug Inc. ("ThermoSnug", "we", "us"). By using the site or placing an order, you agree to these Terms, our Privacy Policy, Refund Policy and Shipping Policy.

1. Who can buy: You must be at least the age of majority where you live to place an order. Our products are intended for ages 14+ and are not toys.

2. Products and safe use: ThermoSnug is a heated comfort product. It is not a medical device and is not intended to diagnose, treat, cure or prevent any condition. Always follow the instructions and safety warnings included with the product: do not use while sleeping, avoid prolonged direct skin contact, do not use on people with poor circulation, diabetes or reduced sensitivity to heat, do not immerse in water, and stop using it if it, the cable or the pad is damaged. We try to show our products accurately, but colours and details may vary slightly from photos.

3. Prices and currency: Prices are shown in US dollars, or in Canadian dollars for shoppers in Canada. Taxes and shipping (if any) are shown at checkout. We may change prices at any time, but the price you pay is the one shown when you place your order. If a product is listed at a clearly wrong price because of an error, we may cancel the order and refund you.

4. Orders: Placing an order is an offer to buy. We may refuse or cancel an order (for example, for suspected fraud, pricing errors, or stock issues); if we cancel after you've paid, we'll refund you in full. Products are for personal use, not resale.

5. Discounts and promotions: Discount codes, including subscriber free-shipping offers, have the terms shown with them, can't be exchanged for cash, can't be combined unless stated, and are limited to one use per customer where stated. Codes are personal to the email address they were issued to. We may end or change a promotion at any time, but changes won't affect orders already placed. We may cancel orders that misuse codes (for example, using multiple accounts). The ThermoSnug Challenge has its own Official Rules on our Challenge page.

6. Shipping, returns and warranty: Shipping is covered by our Shipping Policy. Returns and our 1-year limited warranty are covered by our Refund Policy. Title and risk of loss pass to you when we hand your order to the carrier.

7. Intellectual property: All content on this site — including the ThermoSnug name, logos, the Aviator Penguin design, text, photos and videos — belongs to ThermoSnug Inc. or its licensors. You may not copy or use it without our written permission.

8. Your content: If you send us reviews, photos, videos, or Challenge entries, you give us a non-exclusive, worldwide, royalty-free licence to use them in our marketing, with credit where practical. You confirm the content is yours and doesn't break anyone's rights.

9. Acceptable use: Don't misuse the site: no illegal activity, fraud, scraping, hacking, spam, or attempts to interfere with the site or other users.

10. Disclaimer: Except for the limited warranty in our Refund Policy and any rights you have that can't be excluded by law, the site and products are provided "as is" without other warranties. Some places don't allow these exclusions, so they may not apply to you.

11. Limitation of liability: To the fullest extent allowed by law, ThermoSnug is not liable for indirect, incidental, special or consequential damages, and our total liability for any claim relating to a product is limited to the amount you paid for that product. Nothing in these Terms limits liability that can't be limited by law, including for injury caused by our negligence.

12. Indemnity: You agree to cover our reasonable costs if a claim is brought against us because you broke these Terms or the law.

13. Governing law and where claims are heard: These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. To the extent the law allows, any dispute relating to these Terms, this site or our products will be heard only in the courts of Ontario, Canada. If you're a consumer, you keep any protections given to you by the laws where you live that can't be waived.

14. Shopify: Our store runs on Shopify. Your purchase is made with ThermoSnug Inc., not Shopify, and Shopify isn't responsible for our products.

15. Changes: We may update these Terms by posting a new version here. The version in effect when you place an order applies to that order.
